WhatsApp in healthcare: a real legal risk

WhatsApp is owned by Meta (USA). Healthcare conversation data — including patient references, clinical conditions, incidents, or shift details — transits through American servers subject to non-EU regulations. GDPR Article 9 classifies health data as a "special category" with reinforced obligations. Focus — Care Homes: the night shift cannot operate without a safety net

In a residential care facility, night staff often operate alone in silent corridors with vulnerable residents. A worker who falls, has a medical episode, or finds themselves in difficulty — without an active protection system — may go without help for hours. The DKPS Lone Worker module automatically monitors the operator: it requests presence confirmation at configurable intervals and, if there is no response, immediately sends an SOS alert with exact GPS position to the on-duty coordinator — instantly, not after hours.

GDPR Art. 9: special health data — the obligation applies to operational communications too

The European Regulation classifies health-related data as special categories with reinforced protections. This includes operational communications that mention patients, clinical conditions, incidents, or nursing shifts. WhatsApp (Meta, USA) and WeChat (Tencent, China) do not meet these requirements: data transits through non-EU servers potentially accessible to third parties. The DKPS PoC system uses E2E encryption, servers exclusively in Europe, and a full traceability — designed to satisfy DPO requirements and pass any Data Protection Authority inspection.
